These Terms of Service (“Terms”) govern your use of the Omni Sight website, the Omni Sight Windows application, and related services provided by [Legal Name or Your Name] (“Omni Sight,” “we,” “us,” or “our”).

By accessing the website, downloading the app, or using Omni Sight, you agree to these Terms. If you do not agree, do not use Omni Sight.

1. Eligibility

You must be legally able to enter into a binding agreement to use Omni Sight. If you are using Omni Sight on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

2. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Omni Sight for your personal or internal lawful use.

This license does not transfer ownership of Omni Sight or any intellectual property rights.

3. Permitted Use

You may use Omni Sight only in compliance with:
– these Terms
– applicable laws and regulations
– any rules, policies, or restrictions imposed by games, platforms, stores, tournaments, anti-cheat systems, or service providers you use with Omni Sight

You are solely responsible for determining whether use of Omni Sight is allowed in any specific game, service, competition, or environment.

4. Restrictions

You may not:
– copy, sell, rent, lease, sublicense, or distribute Omni Sight except as allowed by law
– reverse engineer, decompile, or disassemble Omni Sight except to the extent such restriction is prohibited by applicable law
– remove copyright, trademark, or proprietary notices
– use Omni Sight in a way that violates law or third-party rights
– use Omni Sight to interfere with, disrupt, or abuse any game, service, platform, or network
– attempt to gain unauthorized access to our systems, updates, or infrastructure
– use Omni Sight in connection with malware, cheating services, account abuse, or fraudulent conduct

5. Third-Party Platforms, Games, and Services

Omni Sight may be distributed through or used alongside third-party platforms and services, including game stores, communication platforms, operating system services, and games developed by others.

We do not control those third parties, and we are not responsible for:
– their availability
– their policies or terms
– their anti-cheat or enforcement decisions
– compatibility changes they make
– account suspensions, bans, restrictions, or enforcement actions they apply

Use of third-party services is governed by their own terms and policies.

6. Updates and Changes

We may release updates, fixes, patches, or new versions of Omni Sight at any time. We may also modify, suspend, or discontinue all or part of Omni Sight at any time, with or without notice.

We do not guarantee ongoing compatibility with every device, Windows version, game, or platform.

7. Support

We may provide support at our discretion. Nothing in these Terms requires us to provide any specific level of support, maintenance, updates, or response time.

8. Purchases, Stores, and Refunds

If Omni Sight is offered through a third-party store or platform, billing, payment processing, refunds, cancellations, and platform-specific entitlements may be handled by that third party and may be subject to that platform’s terms.

Unless expressly stated otherwise by us in writing, we do not make separate refund promises beyond what is required by applicable law or the relevant platform’s policies.

9. Intellectual Property

Omni Sight, including its software, branding, visuals, text, design, website content, logos, and related materials, is owned by us or our licensors and is protected by applicable intellectual property laws.

Except for the limited license granted in these Terms, no rights are granted to you.

10. Feedback

If you send us ideas, suggestions, bug reports, or other feedback, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and incorporate that feedback without compensation or obligation to you.

11. Privacy

Your use of Omni Sight is also subject to our Privacy Policy.

12. Disclaimers

Omni Sight is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of:
– merchantability
– fitness for a particular purpose
– non-infringement
– accuracy
– reliability
– uninterrupted availability

We do not warrant that Omni Sight will:
– be error-free
– be secure against every threat
– remain continuously available
– be compatible with every system, game, or platform
– meet your expectations or competitive needs

13. Limitation of Liability

To the maximum extent permitted by law, Omni, and its affiliates, licensors, service providers, and representatives will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, account access, or business opportunity, arising out of or related to your use of or inability to use Omni Sight.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to Omni Sight or these Terms will not exceed the greater of:
– the amount you paid us for Omni Sight in the 12 months before the claim arose, or
– USD $50

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnity

You agree to defend, indemnify, and hold harmless Omni and its affiliates, licensors, service providers, and representatives from and against claims, liabilities, damages, losses, and expenses arising out of or related to:
– your use of Omni Sight
– your violation of these Terms
– your violation of applicable law
– your violation of third-party rights
– your misuse of games, platforms, or services in connection with Omni Sight

15. Termination

We may suspend or terminate your access to Omni Sight at any time if we believe you violated these Terms, created risk for us or others, or if we discontinue the product.

Upon termination, the license granted to you ends immediately, and you must stop using Omni Sight.

Sections that by their nature should survive termination will survive, including sections relating to intellectual property, disclaimers, limitations of liability, indemnity, and governing law.

16. Governing Law

These Terms are governed by the laws of California, without regard to conflict of laws principles.

Any dispute arising out of or relating to these Terms or Omni Sight will be resolved in the courts located in California, and you consent to that jurisdiction and venue, unless applicable consumer law requires otherwise.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the revised Terms and update the Effective Date above. Your continued use of Omni Sight after updated Terms become effective means you accept the revised Terms.
